At Grove Labs, Inc. (“Grove”), we want to help more people grow and eat sustainable, organic, and hyperlocal food. Our Grove Garden™ is an intelligent indoor garden that enables people to grow fresh, flavorful and healthy food year-round. The GroveApp allows users to monitor and operate their Grove Garden online. Through our Grove mobile app, users can purchase seeds and supplies through the Grove Market™ and connect, interact, and share information about their Grove Gardens with other users through the Grove Community™.

Who Is Eligible To Use The Services?
Grove’s Services are intended for legal use by adults or under adult supervision only and are not directed to minors under the age of 13. You may not use the Services in any illegal manner or if you are under the age of 13.
Information Collection & Use
Grove gathers various types of information when you access or use the Services. The types of information Grove may collect include:
Personally Identifiable Information: Grove may collect Personally Identifiable Information about you through your use of the Services, including information you provide to Grove or post in the Grove Community. “Personally Identifiable Information” refers to information about you that may be used to identify you, such as your: first name, last name, gender, birth date, city, state, zip code, addresses, email address, or phone number. We may combine Personally Identifiable Information we collect with additional information we collect about you or obtain from third-party sources.
Grove will not share your Personally Identifiable Information outside of Grove unless we have your consent or if the information is used to provide you the Services. You are not required to provide us your Personally Identifiable Information; however, if you choose to withhold certain Personally Identifiable Information, we may not be able to provide you the Services.
Grove Account Information: Grove may require you to register for an account in order to use certain Services, such as GroveApp (a “Grove Account”). Grove may collect information about you in connection with your registration for your Grove Account, which may include Personally Identifiable Information and other information such as a username, password, personal profile, pictures, your location, and information about your contacts. You may choose to upload your address book so that we can help you find users you know or help other users find you. If you connect your Grove Account to an account on another service, the other service may send us your registration or profile information with that service or other information you have authorized. Please be aware that some of your Grove Account information may be displayed publicly, such as within the Grove Community. See the Grove privacy settings for more information and to change your settings.
Grove Garden™ and Services Use Information: The Grove Garden™ contains sensors that collect information about the use of the Grove Garden, such as air temperature, humidity, water, and light levels, and electricity use. Other Grove Services, such as GroveAppaa and the Grove mobile application, collect information relating to your use of the Grove Garden, such as plants and supplies you’ve purchased or grown, and your interactions with other Grove users through the Grove Community. Grove collects and stores this information to help us improve the Grove Garden and our Services for you and other users.
Location Information: When you use the Services, we may access, collect, monitor and/or remotely store data about your location, which may include your address, zip code, GPS coordinates, or similar information regarding the status and location of your Grove Garden, your computer, or other devices used to access the Services (“Location Information”). Grove may also use Location Information via third party APIs such as Apple’s Region Monitoring or Google Geofence API to help provide intelligent notifications to our users regarding updates or actions they should take relating to their Grove Garden or other Services. Location Information allows us to help monitor and maintain your Grove Garden and help improve our Services for other Grove users. Your Location Information may also be used to display your location and other information on a map to other users. Some features of the Services, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.
Correspondence Information: If you email us, subscribe to our newsletters or mailing lists, or purchase products through the Grove Market, we may keep your message, email address, and contact information to respond to your requests, provide the requested Service, and to provide notifications or other correspondences to you. If you no longer wish to receive such correspondence from Grove or our partners, you may opt-out of receiving these communications according to information provided within the correspondence, or by contacting us using the contact information provided below. Please note we may still need to contact you regarding certain important service announcements or notifications.
Public Information: Grove may collect information about you from other publicly available sources. In addition, all information you make publicly available in any public or open forum, such as on a social network, including within the Grove Community, may be considered public information for the purposes of this Policy, and may be accessed and collected by Grove. Please be aware that any content or information you share with or provide to third parties using or related to your use of the Services is neither private, nor confidential. Grove is not responsible for any content or information you post or share with third parties. If you do not wish for certain information to be public, please do not share it.
Links: Grove may keep track of how you interact with links across the Services, including our email correspondences, third-party services, and client applications. We do this to help analyze the use of and improve the Services. Link information is generally only analyzed on an aggregate basis.
Cookies, Web Beacons And Other Tracking Technologies: Like many other services, Grove may automatically collect certain information and data from your browser or device through the use of “cookies,” “web beacons,” and other tracking technologies. A cookie is a small data file that is transferred to your computer or mobile device. Grove may use both session cookies and persistent cookies. A “web beacon” is a small graphic image placed on a website or in an email that is used to gather data about a user’s use of the website or email. Through these technologies we may collect information about your use of the Services and other online activities, including certain online activities after you leave the Services. We may use these tracking technologies to provide and enhance the Services, provide updates to the Services, capture technical information about users’ use of the Services, and provide personalized content, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns. Most Internet browsers automatically accept cookies. You can typically change your browser settings to stop accepting cookies or to prompt you before accepting a cookie from the services you visit. However, some Services may not function properly if you disable cookies. We encourage you to learn more about your ability to manage cookies and web beacons by consulting the privacy features of your devices and browsers.
Unique Identifiers: When you use or access the Services, we may access, collect, monitor, store on your device, and/or remotely store one or more "Unique Identifiers," such as a universally unique identifier (“UUID”). These Unique Identifiers may be associated with your device, whether or not you establish a Grove Account. Unique Identifiers are small data files or similar data structures stored on or associated with your device that uniquely identify your device. A Unique Identifier may be data stored in connection with the device hardware, in connection with the device's operating system or other software, or via data sent to the device by Grove. A Unique Identifier may convey information to Grove or to a third party partner about how you browse and use the Services and may help us or others provide reports or personalized content and advertisements. A Unique Identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Services. Some features of the Services may not function properly if use or availability of Unique Identifiers is impaired or disabled.
Log File Information: When you use our Services, we may receive log file information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We receive log file data when you interact with our Services, for example, when you visit our websites, sign into our Services, or interact with our email notifications. Grove uses log file data to provide, understand, and improve our Services, and to customize the content we show you. Grove may link this log file to other information Grove collects about you via the Services.
Commerce Transaction Information: You may provide payment information, including your credit or debit card number, card expiration date, CVV code, and billing address (collectively, “Payment Information”), along with your shipping address, to complete a commerce transaction through our Services, including the Grove Market. Grove currently partners with third party e-commerce Service Providers for all commerce transactions. Our Service Provider processes all payment transactions on behalf of Grove, but may provide certain non-financial information to Grove regarding commerce transactions. We consider your Payment Information and address private and will not make such information public. We may collect and store information related to your purchases made through our Services.
Information Use & Sharing
Grove Personnel: Grove’s personnel and authorized partners may have access to your information as needed to operate the Services in the normal course of business.
Service Providers: Grove works with various organizations and individuals to help provide the Services to you ("Service Providers"), such as hosting companies, payment processors to process payments in Grove Market, or companies that provide analytics information, like Google Analytics. We may share your personal information with our Service Providers solely for the purpose of providing the Services. The information we share to our Service Providers may include both information you provide to us and information we collect about you, including Personally Identifiable Information, Payment Information (to our payment processing providers only), information from data collection tools like cookies, web beacons, log files, Unique Identifiers, and location data. Grove will take reasonable steps to ensure that our Service Providers are obligated to reasonably protect your information on Grove’s behalf. If Grove becomes aware that any Service Provider is using or disclosing information improperly, we will take commercially reasonable steps to end or correct such improper use or disclosure.
For Research Purposes: It is important to Grove to use its Services to assist in horticultural research and development. Grove may share and sell certain non-Personally Identifiable Information collected through your use of the Services to third party entities for use for research purposes. In some instances, Grove may use your information to assist our research partners in certain advertising or marketing campaigns and may direct ads or marketing to you using your information.
Business Transactions: Grove may purchase other businesses or their assets, sell our business assets, or be involved in a bankruptcy, merger, acquisition, reorganization or sale of assets (a “Business Transaction”). Your information, including Personally Identifiable Information, may be sold or transferred as part of a Business Transaction.
Accessing & Modifying Your Information
Do I Have Access To The Information Grove Has Collected About Me?
You do. For users with a Grove Account, Grove provides certain tools and settings within the Services to help you access, correct, delete, or modify the personal information you provided to us and associated with your account. In addition, Grove welcomes you to contact us regarding the information we have collected about you using the contact information provided below, including regarding the nature and accuracy of the data has collected about you or to request an update or deletion of your information. Requests to delete or remove your information does not ensure complete or comprehensive removal of the content or information posted, and removed information may persist in backup copies indefinitely.
Please note that if you choose to delete your information or opt-out of the collection and use of your information, you understand that certain features, including but not limited to access to the Services, may no longer be available to you, and Grove specifically reserves the right to terminate your access to the Services and any contract you have with Grove related to the Services.
Can I Opt-Out of Communications from Grove?
You may unsubscribe from email communications from us by clicking on the "unsubscribe” link provided within the communication. You may not, however, opt-out of Services-related communications, for example, account verification, purchase and billing confirmations and reminders, changes or updates to features of the Services, or technical and security notices.
How Long Does Grove Keep My Information?
We may store the information we collect about you indefinitely, but information generally will be retained only for as long as necessary to fulfill the purposes for which the information was collected, or as otherwise required by law. Following termination or deactivation of your Grove Account, Grove may retain your information and content for a commercially reasonable time for backup, archival, and audit purposes.
Do Not Track
Grove does not currently employ a process for automatically responding to “Do Not Track” (DNT) signals sent by web browsers, mobile devices, or other mechanisms. Per industry standards, third parties may be able to collect information, including Personally Identifiable Information, about your online activities over time and across different websites or online services when you use Services. You may opt out of online behavioral ads at http://www.aboutads.info/choices/. You also may limit certain tracking by disabling cookies in your web browser.
How Does Grove Secure My Information?
Grove takes reasonable efforts to secure and protect the privacy, accuracy, and reliability of your information and to protect it from loss, misuse, unauthorized access, disclosure, alteration and destruction. Grove implements security measures as we deem appropriate and consistent with industry standards. As no data security protocol is impenetrable, Grove cannot guarantee the security of our systems or databases, nor can we guarantee that personal information we collect about you will not be breached, intercepted, destroyed, accessed, or otherwise disclosed without authorization. Accordingly, any information you transfer to or from Services is provided at your own risk.
Please do your part to help us keep your information secure. You are responsible for maintaining the confidentiality of your password and Grove Account, and are fully responsible for all activities that occur under your password or Grove Account. Grove specifically reserves the right to terminate your access to the Services and any contract you have with Grove related to the Services in the event it learns or suspects you have disclosed your Grove Account or password information to an unauthorized third party.
What If There is a Data Security Incident?
In the event that any information under our control is compromised as a result of a breach of security or other data security incident, Grove will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with applicable laws and regulations. We are not responsible for the functionality, privacy, or security measures of any other organization.
Additional Provisions Regarding The Services & Your Information
We may provide links and pointers to websites and services maintained by other organizations. Grove provides these links as a convenience to users, but it does not operate, control or endorse such sites. When you access these third party services, you become subject to their privacy policies. Grove disclaims any responsibility for the information on those sites and any products or services offered there, and cannot vouch for the privacy policies of such sites. Grove does not make any warranties or representations that any linked sites will function without error or interruption, or that defects will be corrected. Grove’s inclusion of links or interfaces to third party services does not imply an endorsement of the material on such sites or of their owners or operators.
Does Grove Warranty Information It Provides Via The Services?
No. Access to the information provided by the Services is provided by Grove as a service to its customers, website visitors, and users of its Services, without warranty of any kind. References herein to any product, process, or service does not constitute or imply endorsement or recommendation by Grove. While Grove makes an effort to present accurate and reliable information on the Services, Grove does not approve or certify such information and does not guarantee the accuracy, completeness, efficacy, timeliness, or sequencing of such information. Your use of such information is voluntary, and reliance on it should only be undertaken after an independent review of its applicability, accuracy, completeness, efficacy, and timeliness with regard to your specific needs and uses. Grove (including its employees and agents) is not responsible for, and expressly disclaims all liability for, damages of any kind arising out of use, reference to or reliance on the information available through the Services. No approvals, recommendations, endorsements, guarantees, or warranties, including, but not limited to, any express or implied warranties of merchantability or fitness for any particular use or purpose of products or services named through the Services is made by Grove.
Where Is My Information Transferred Or Stored?
Please note information Grove collects about you may be transferred, processed and/or accessed by us in the United States, or another country where we, or our Service Providers, operate. Please be aware Personally Identifiable Information may be transferred to, and maintained on, computers located outside of your state or country where the privacy laws may differ from and may not be as protective as those where you live. If you are located outside the United States and choose to allow us to collect information about you, please be aware that Grove may transfer your Personally Identifiable Information to the United States and process and store it there. By allowing collection of your Personally Identifiable Information, you consent to having your personal data transferred to, processed, and stored in the United States.
How Can I Safely Use Grove’s Services?
Despite Grove’s safety and privacy controls, we cannot guarantee the Services are entirely free of illegal, offensive, pornographic, or otherwise inappropriate material, or that you will not encounter inappropriate or illegal conduct from other users when using the Services.
